SADC LAWYERS' ASSOCIATION (SADCLA) ANNUAL CONFERENCE AND GENERAL MEETING

Did you know that The Annual Conference and General Meeting of SADCLA is going to be hosted by TLS in Dar es Salaam?

Tanzanian Law Firms that register 5 members or more will be entitled to a $20/discount per registrant, therefore paying $280 per registrant until 31 July 2015.
Late registration after 31st July 2015 will attract payment of $450 with No exception

OBITUARY

We regret to inform you of the untimely demise of Advocate Winfrida Lawrence Kagombola, Roll Number 842 .
The late Winfrida Lawrence Kagombola, passed away on Monday, 6th April 2015.
The Mass and last respect for the late Advocate Winfrida Lawrence Kagombola will be held on Thursday, 9th April, 2015 at St. Gasper Catholic Church in Mbezi Beach from 12.00 AM. Last respects will also be held at her residence located opposite Jogoo Bus Station Mbezi Beach near Art Gallery from 10.00AM.
Her body will then be transported to Songea- Manda for burial to be conducted on 10th April 2015.
Advocates are requested to attend and are requested to dress in bibs and robes.

MAY THE ALMIGHTY GOD REST HER SOUL IN ETERNAL PEACE, AMEN.

Court of Appeal Post Session Appraisal

Following a meeting on Court of Appeal Post Session Appraisal which looked back at the Court of Appeal Session to identify challenges and achievements made, the following issues have been noted which require your immediate attention and or action.

It is noteworthy that the general finding was that the last Court of Appeal Session was 78%. Successful in terms of the number of appeals, applications and revisions finalized compared to those on the cause list. In the case of appeals, only two cases were adjourned and both were adjourned because Counsels were reported sick. Hence the following issues were raised and are relevant to you in order to ensure that future sessions do not fall short of targets because of conduct on Advocates:-

(a) Absence of Counsel on Medical Grounds: it was reported that in one matter Counsel who did not enter appearance notified the court by word of mouth through Opposing Counsel without the courtesy of giving written notice to court. Therefore it was resolved that in future, where Counsel will fail to enter appearance and the reasons given are medical, the court will direct production of medical documents within the Session period and if no documents are produced the court will take appropriate decision within the Court of Appeal Rules. Members are therefore cautioned that the Court of Appeal will not be liberally permissive on this score in future sessions.

(b) The Report by the Registrar had instances of Advocates declining to accept service on the ground that they withdrew from a matter when their names are still on court record as Counsel in the matter. Therefore Counsels are requested in such situations to accept service and enter appearance to notify the court that they are no longer representing the clients. At the very least, Counsel should communicate to the Court in writing and cooperate to ensure their previous clients are served. The meeting appreciated that so far the obligation to notify the court of change of Advocates lies on the parties but in the interest of ensuring speedy disposal of cases and out of courtesy to the court, members are urged to assist outside the Rules if the aim is to assist the Court.
